ACORDO DE LICENCIAMENTO DO USUÁRIO FINAL
PARA O RACK2-VIEWER (VERSÃO EXPERIMENTAL)

Este Acordo de Licença do Usuário Final ("EULA") é um acordo legal 
entre o comprador original deste software e a PFU LIMITED ("PFU") para 
a versão experimental do software PFU conhecido como Rack2-Viewer, 
incluindo a mídia associada ("Software").

AO INSTALAR, COPIAR OU USAR ESTE SOFTWARE, VOCÊ CONCORDA EM 
ESTAR LIGADO AOS TERMOS DESTE EULA.  SE VOCÊ NÃO CONCORDAR 
COM OS TERMOS DESTE EULA, NÃO INSTALAR OU USAR O SOFTWARE; 
VOCÊ DEVERÁ DESTRUIR O SOFTWARE.

1. Instalação e Uso
Você pode instalar e usar o Software em apenas (1) computador por vez.  
Você pode usar o Software por até quarenta (30) dias depois da 
instalação, depois do qual o Software não irá funcionar.

2. Restrições
(1) Você não deve modificar ou realizar, exceto através de 
 expressamente permitido pela lei aplicável, engenharia reversa, 
 incluindo, sem limitação,decomposição ou desmontagem, o Software.
(2) Você não deverá copiar ou distribuir (incluindo distribuição em 
 rede) "Fichário Rack2 com Viewer embutido (*.exe)" gerado pela função 
 exportar do Software, exceto para seu próprio uso pessoal.
(3) Seu conhecimento e aceitação que o Software não é designado, 
 desenvolvido ou fabricado para qualquer uso que possa compreender 
 riscos fatais ou perigos, a não ser sob extrema segurança, o uso pode 
 levar a morte, danos pessoais, danos físicos graves e outras perdas 
 (citados aqui, "Uso Solicitado de Alta Segurança"), incluindo sem 
 limitação, controle de reação nuclear em locais nucleares, controle 
 de tráfego de espaçonaves, controle de tráfego aéreo, controle de 
 transporte em massa, sistema médico de suporte à vida e controle de 
 lançamentos de mísseis em sistemas bélicos.
 Você concorda em não usar o Software em qualquer Uso Necessário de 
 Alta Segurança.
 A PFU LIMITED se abstém de qualquer responsabilidade de danos 
 causados pelo uso do Software em qualquer Uso Necessário de Alta 
 Segurança.
(4) Você tem conhecimento e concorda que a PFU não é responsável por 
 qualquer dano ao Software ou para seu computador ou rede do 
 computador causado por acessos não autorizados e vírus de computador.  
 É sua responsabilidade tomar as medidas de segurança adequada para 
 evitar acesso não autorizado ao seu computador ou rede do computador.

3. Reserva de Direitos e Propriedade
 A PFU ou seus fornecedores possuem o título, direitos autorais e 
 outros direitos de propriedade intelectual no Software.  O Software é 
 protegido por direitos autorais e outras leis de propriedade 
 intelectuais e declarações.  
 Exceto pelo expressamente declarado aqui, este EULA não fornece a 
 você qualquer direito de propriedade intelectual no Software.
 Todos os direitos não expressamente garantidos são reservados pela 
 PFU e seus fornecedores.

4. Declaração
Você concorda em não transferir o Software para terceiros, a qualquer 
momento por qualquer razão.

5. Controle de Exportação
 Você concorda em observar todas as leis nacionais e internacionais 
 que se destinam ao Software, incluindo os Regulamentos de 
 Administração de Exportação dos EUA, assim como as restrições do 
 usuário final, uso final e destino declarados pelos EUA e outros 
 governos.

6. SEM GARANTIA
VOCÊ CONCORDA EM ACEITAR ESTE SOFTWARE "COMO É".  A PFU E 
SEUS FORNECEDORES NÃO FORNECEM GARANTIA RELACIONADAS A ESTE 
SOFTWARE E QUALQUER USO DESTE SOFTWARE FICA A SEU PRÓPRIO 
RISCO. A EXTENSÃO MÁXIMA PERMITIDA POR LEI, PFU E SUAS 
AFILIADAS EXCLUEM TODAS AS GARANTIAS IMPLICADAS DE 
COMERCIALIZAÇÃO, AJUSTE PARA PROPÓSITO PARTICULAR E NÃO 
INFRIGIMENTO.

7. LIMITAÇÃO DE CONFIANÇA
SOB NENHUMA CIRCUNSTÂNCIA A PFU OU SEUS FORNECEDORES SERÃO 
RESPONSÁVEIS A VOCÊ OU QUALQUER OUTRA PESSOA SOB DELITOS, 
CONTRATOS OU QUALQUER OUTRA TEORIA LEGAL PARA QUALQUER 
DANO DIRETO, INDIRETO, ESPECIAL, INCIDENTAL OU CONSEQUENCIAL 
DE QUALQUER TIPO SOB O USO, DESEMPENHO OU NÃ0-DESEMPENHO  
DO SOFTWARE, INCLUINDO, SEM LIMITAÇÃO, DANOS PARA PERDA DE 
LUCROS, PERDA DE VALORES OU PERDA DE DADOS, MESMO SE A PFT 
FOI INFORMADA DA POSSIBILIDADE DE TAIS DANOS. ALGUMAS 
JURISDIÇÕES NÃO PERMITEM A EXCLUSÃO OU LIMITAÇÃO DE DANOS 
INCIDENTAIS OU CONSEQUENCIAIS, ENTÃO ESTAS LIMITAÇÕES E 
EXCLUSÕES NÃO SE APLICAM A VOCÊ.

8. Provisões Diversas
(1) Se você falha ao observar os termos e condições deste EULA, esta 
 licença e seus direitos no Software serão encerrados imediatamente.
 Em tal caso, você deve destruir todas as cópias do Software e todas 
 suas partes componentes.
(2) Este EULA será governado e construído de acordo com as leis 
 substantivas do mJapão. Esta EULA não será governada pelo conflito de 
 regras legais de qualquer jurisdição ou pela Convenção das Nações 
 Unidas em Contratos para a Venda Internacional de Bens, a aplicação 
 da qual é expressamente excluída.
(3) Este EULA está completamente de acordo entre você e a PFU LIMITED 
 relacionada ao Software e substitui todas as comunicações escritas ou 
 orais contemporâneas ou anteriores, propostas e representações a 
 respeito do Software.
(4) Se qualquer provisão deste EULA é dada como inválida ou 
 inaplicável por qualquer razão, as outras provisões devem continuar 
 em força total e efeito.

END-USER LICENSE AGREEMENT
FOR RACK2-VIEWER (TRIAL VERSION)

This End-User License Agreement ("EULA") is a legal agreement between
the original end user of this software and PFU LIMITED ("PFU") for the
trial version of the PFU software known as the Rack2-Viewer, including
the associated media ("Software").

BY INSTALLING OR USING THIS SOFTWARE, YOU AGREE TO BE BOUND
BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS
OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE; YOU SHALL
DESTROY THE SOFTWARE.

1. Installation and Use
 You may install and use the Software on any one (1) computer at a time.
 You may use the Software for up to thirty (30) days after installation,
 after which time the Software will not function.

2. Restrictions
(1) You shall not modify or, except to the extent expressly permitted
 by applicable law, reverse engineer, including, without limitation,
 decompile or disassemble, the Software.
(2) You shall not copy or distribute (including network distribution)
 "Rack2 Binder with embedded Viewer (*.exe)" generated by the export
 function of the Software, except for your own personal use.
(3) You acknowledge and agree that the Software is not designed,
 developed or manufactured for any use that may give rise to fatal
 risks or dangers such that, unless extremely high safety is secured,
 the use could lead to death, personal injury, severe physical damage,
 or other loss (hereinafter, "High Safety Required Use"), including
 without limitation, nuclear reaction control in nuclear facilities,
 aircraft flight control, air traffic control, mass transport control,
 medical life support systems, and missile launch control in weapon
 systems.
 You agree not to use the Software in any High Safety Required Use.
 PFU LIMITED disclaims any liability for damages cause by use of the
 Software in any High Safety Required Use.
(4) You acknowledge and agree that PFU is not liable for any damage to the
 Software or to your computer or computer network caused by unauthorized
 access or computer viruses. It is your responsibility to take proper
 security measures to avoid unauthorized access to your computer or
 computer network.

3. Reservation of Rights and Ownership
 PFU or its suppliers own the title, copyright, and other intellectual
 property rights in the Software. The Software is protected by copyright
 and other intellectual property laws and treaties. Except as expressly
 stated herein, this EULA does not grant you any intellectual property
 rights in the Software.
 All rights not expressly granted are reserved by PFU and its suppliers.

4. Assignment
 You agree not to transfer the Software to any third party at any time
 for any reason.

5. Export Control
 You agree to comply with all applicable international and national
 laws that apply to the Software, including the U.S. Export Administration
 Regulations, as well as end-user, end-use, and destination restrictions
 issued by the U.S. and other governments.

6. NO WARRANTY
 YOU AGREE TO ACCEPT THIS SOFTWARE "AS IS." PFU AND ITS
 SUPPLIERS PROVIDE NO WARRANTY OR GUARANTY WHATSOEVER
 REGARDING THE SOFTWARE, AND ANY USE OF THE SOFTWARE IS AT
 YOUR OWN RISK. TO THE MAXIMUM EXTENT ALLOWABLE BY LAW, PFU
 AND ITS AFFILIATES EXCLUDE ALL IMPLIED WARRANTIES OF
 MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
 NON-INFRINGEMENT.

7. LIMITATION OF LIABILITY
 UNDER NO CIRCUMSTANCES SHALL PFU OR ITS SUPPLIERS BE LIABLE
 TO YOU OR TO ANY OTHER PERSON UNDER TORT, CONTRACT, OR ANY
 OTHER LEGAL THEORY, FOR ANY DIRECT, INDIRECT, SPECIAL,
 INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER
 ARISING FROM THE USE, PERFORMANCE OR NON-PERFORMANCE OF THE
 SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS
 OF PROFITS, LOSS OF GOODWILL, LOSS OF DATA, DEATH, OR
 PERSONAL INJURY, EVEN IF PFU HAS BEEN INFORMED OF THE
 POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT
 ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR
 CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS AND EXCLUSIONS
 MAY NOT APPLY TO YOU.

8.Miscellaneous Provisions
(1) If you fail to comply with the terms and conditions of this EULA,
 this license and your rights in the Software shall terminate immediately.
 In such event, you must destroy all copies of the Software and all of its
 component parts.
(2) This EULA will be governed by and construed in accordance with the
 substantive laws of Japan. This EULA will not be governed by the conflict
 of law rules of any jurisdiction or by the United Nations Convention on
 Contracts for the International Sale of Goods, the application of which
 is expressly excluded.
(3) This EULA is the entire agreement between you and PFU LIMITED relating
 to the Software, and it supersedes all prior or contemporaneous oral or
 written communications, proposals and representations with respect to
 the Software.
(4) If any provision of this EULA is held to be invalid or unenforceable
 for any reason, the other provisions shall continue in full force
 and effect.
