CONTRATTO CON L'UTENTE FINALE
PER RACK2-VIEWER (VERSIONE DI PROVA)

Questo contratto con l'utente finale ("EULA") un contratto legale tra
l'utente finale originale del software e PFU LIMITED ("PFU") per la 
versione di prova del software PFU conosciuto come Rack2-Viever, 
compreso il supporto associato ("Software").

PER L'INSTALLAZIONE O L'UTILIZZO DEL SOFTWARE, 
LEI ACCETTA I TERMINI DI QUESTO EULA.  SE NON 
ACCETTA I TERMINI DI QUESTO EULA, NON INSTALLI 
O USI IL SOFTWARE; DEVE DISTRUGGERE IL SOFTWARE.

1. Installazione ed uso
 Può installare ed utilizzare il Software su un solo (1) computer alla
 volta. Può utilizzare il Software per un periodo di tempo di trenta 
 (30) giorni dopo l'installazione, al termine di questo periodo il 
 Software non sarà più utilizzabile.

2. Limitazioni
(1) Non può modificare o, se non nella misura consentita dalla
 normativa applicabile, eseguire il reverse engineering, e senza 
 limitazione, decompilare o smontare il Software.
(2) Non può copiare o distribuire (compresa la distribuzione di rete) 
 "Rack2 raccoglitore con insieme Viewer (*.exe)" generate con la 
 funzione di esportazione del Software, ad eccezione dell'uso personale.
(3) Accetta ed è a conoscenza che il Software non è progettato, 
 sviluppato o costruito per un uso che può generare rischi fatali o 
 pericoli tali, a meno che non viene garantita la massima sicurezza, 
 da causare morte, lesioni personali, gravi danni fisici, o altri 
 problemi (in seguito, "Uso richiesto con elevato livello di 
 sicurezza"), e senza limitazione, controllo di reazioni nucleari in 
 installazioni nucleari, controllo del traffico aereo, controllo dei
 trasporti di massa,sistemi medici salva vita, e controllo per il 
 lancio di missili in sistemi di armamento.Accetta di non utilizzare 
 il Software in qualsiasi Uso richiesto con elevato livello di 
 sicurezza.
 PFU LIMITED declina qualsiasi responsabilità per i Danni causati 
 dall'uso del Software in Uso richiesto con elevato livello di 
 sicurezza.
(4) Accetta ed è a conoscenza che PFU non è responsabile per qualsiasi
 tipo di danno al Software o al computer o rete di computer causato 
 dall'accesso non autorizzato o da virus del computer.  È propria 
 responsabilità adottare misure di protezione per evitare l'accesso 
 non autorizzato al computer o alla rete di computer.

3. Limitazione di Diritti e Proprietà
 PFU o i fornitori a suo titolo, copyright, e altri diritti sulle 
 proprietà intellettuali nel Software.  Il Software protetto da 
 copyright e altre norme e accordi sulla proprietà intellettuale. 
 Eccetto come stabilito in questo documento, EULA riconosce all'utente
 alcun diritto sulla proprietà intellettuale sul Software.Tutti i 
 diritti non espressamente riconosciuti sono riservati a PFU e ai 
 suoi fornitori.

4. Cessione
 Accetta di non trasferire il Software a terse parti in nessun momento
 per nessuna ragione.

5. Controllo sull'esportazione
 È necessario rispettare tutte le norme nazionali e internazionali 
 applicabili al Software, comprese le U.S. Export Administration 
 Regulations, così come le restrizioni utente finale, uso finale, 
 e destinazione emesse dagli Stati Uniti e altri governi.

6. NESSUNA GARANZIA
 ACCETTA QUESTO SOFTWARE "COSÌ COME È." PFU E I SUOI 
 FORNITORI NON RILASCIANO ALCUNA GARANZIA O ALTRA 
 GARANZIA DI QUALSIASI NATURA IN MERITO A QUESTO 
 SOFTWARE, E QUALSIASI USO DEL SOFTWARE È A PROPRIO 
 RISCHIO.  NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE,
 PFU E I SUOI AFFILIATI ESCLUDONO TUTTE LE GARANZIE DI
 COMMERCIABILITÀ IMPLICITE, IDONEITÀ A PARTICOLARI SCOPI, 
 E NON-VIOLAZIONE.

7.  LIMITAZIONE DI RESPONSABILITÀ
 IN NESSUNA CIRCOSTANZA PFU O I SUOI FORNITORI SARÀ 
 RESPONSABILE VERSO L'UTENTE O ALTRE PERSONE DI ILLECITO,
 CONTRATTO, O QUALSIASI ALTRA MATERIA LEGALE, PER DANNI 
 DIRETTI, INDIRETTI, SPECIALI, ACCIDENTALI, O 
 CONSEGUENZIALI DI NESSUN CARATTERE DERIVANTI DALL'USO, 
 RENDIMENTO O NON RENDIMENTO DEL SOFTWARE, COMPRESI, 
 SENZA LIMITAZIONE, DANNI PER PERDITA DI PROFITTI, 
 PERDITA DI AVVIAMENTO COMMERCIALE, PERDITA DI DATI, 
 MORTE, O LESIONI PERSONALI, ANCHE SE PFU È STATO 
 INFORMATO DELLA POSSIBILITÀ DI QUESTI DANNI.  ALCUNE
 GIURISDIZIONI NON PERMETTONO L'ESCLUSIONE O LA 
 LIMITAZIONE DI DANNI ACCIDENTALI O CONSEGUENZIALI, 
 POICHÉ QUESTE LIMITAZIONI ED ESCLUSIONI POTREBBERO NON
 ESSERE APPLICATE ALL'UTENTE.

8. Previsioni varie
(1) La mancata conformità con i termini e condizioni del presente EULA,
 questa licenza e i diritti sul Software termineranno immediatamente.
 In questo caso, è necessario distruggere tutte le copie del Software 
 e tutte le parti componenti.
(2) Questo EULA sarà amministrato da e redatto in accordo alle
 leggi effettive del Giappone. Questo EULA non è governato da conflitti
 di norme legali di alcuna giurisdizione o da United Nations Convention
 sui Contratti per la Vendita di beni internazionali, l'applicazione 
 della quale è espressamente esclusa.
(3) Questo EULA è un contratto tra l'utente e PFU LIMITED relativamente
 al Software, e sostituisce tutte le comunicazioni verbali o scritte 
 attuali o precedenti, proposte e rappresentate con rispetto al 
 Software.
(4) Se qualsiasi previsione espressa in questo EULA è considerate non 
 valida o non tutelabile in giudizio per qualsiasi ragione, le altre 
 previsioni continueranno ad essere valide.

END-USER LICENSE AGREEMENT
FOR RACK2-VIEWER (TRIAL VERSION)

This End-User License Agreement ("EULA") is a legal agreement between
the original end user of this software and PFU LIMITED ("PFU") for the
trial version of the PFU software known as the Rack2-Viewer, including
the associated media ("Software").

BY INSTALLING OR USING THIS SOFTWARE, YOU AGREE TO BE BOUND
BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS
OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE; YOU SHALL
DESTROY THE SOFTWARE.

1. Installation and Use
 You may install and use the Software on any one (1) computer at a time.
 You may use the Software for up to thirty (30) days after installation,
 after which time the Software will not function.

2. Restrictions
(1) You shall not modify or, except to the extent expressly permitted
 by applicable law, reverse engineer, including, without limitation,
 decompile or disassemble, the Software.
(2) You shall not copy or distribute (including network distribution)
 "Rack2 Binder with embedded Viewer (*.exe)" generated by the export
 function of the Software, except for your own personal use.
(3) You acknowledge and agree that the Software is not designed,
 developed or manufactured for any use that may give rise to fatal
 risks or dangers such that, unless extremely high safety is secured,
 the use could lead to death, personal injury, severe physical damage,
 or other loss (hereinafter, "High Safety Required Use"), including
 without limitation, nuclear reaction control in nuclear facilities,
 aircraft flight control, air traffic control, mass transport control,
 medical life support systems, and missile launch control in weapon
 systems.
 You agree not to use the Software in any High Safety Required Use.
 PFU LIMITED disclaims any liability for damages cause by use of the
 Software in any High Safety Required Use.
(4) You acknowledge and agree that PFU is not liable for any damage to the
 Software or to your computer or computer network caused by unauthorized
 access or computer viruses. It is your responsibility to take proper
 security measures to avoid unauthorized access to your computer or
 computer network.

3. Reservation of Rights and Ownership
 PFU or its suppliers own the title, copyright, and other intellectual
 property rights in the Software. The Software is protected by copyright
 and other intellectual property laws and treaties. Except as expressly
 stated herein, this EULA does not grant you any intellectual property
 rights in the Software.
 All rights not expressly granted are reserved by PFU and its suppliers.

4. Assignment
 You agree not to transfer the Software to any third party at any time
 for any reason.

5. Export Control
 You agree to comply with all applicable international and national
 laws that apply to the Software, including the U.S. Export Administration
 Regulations, as well as end-user, end-use, and destination restrictions
 issued by the U.S. and other governments.

6. NO WARRANTY
 YOU AGREE TO ACCEPT THIS SOFTWARE "AS IS." PFU AND ITS
 SUPPLIERS PROVIDE NO WARRANTY OR GUARANTY WHATSOEVER
 REGARDING THE SOFTWARE, AND ANY USE OF THE SOFTWARE IS AT
 YOUR OWN RISK. TO THE MAXIMUM EXTENT ALLOWABLE BY LAW, PFU
 AND ITS AFFILIATES EXCLUDE ALL IMPLIED WARRANTIES OF
 MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
 NON-INFRINGEMENT.

7. LIMITATION OF LIABILITY
 UNDER NO CIRCUMSTANCES SHALL PFU OR ITS SUPPLIERS BE LIABLE
 TO YOU OR TO ANY OTHER PERSON UNDER TORT, CONTRACT, OR ANY
 OTHER LEGAL THEORY, FOR ANY DIRECT, INDIRECT, SPECIAL,
 INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER
 ARISING FROM THE USE, PERFORMANCE OR NON-PERFORMANCE OF THE
 SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS
 OF PROFITS, LOSS OF GOODWILL, LOSS OF DATA, DEATH, OR
 PERSONAL INJURY, EVEN IF PFU HAS BEEN INFORMED OF THE
 POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT
 ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR
 CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS AND EXCLUSIONS
 MAY NOT APPLY TO YOU.

8.Miscellaneous Provisions
(1) If you fail to comply with the terms and conditions of this EULA,
 this license and your rights in the Software shall terminate immediately.
 In such event, you must destroy all copies of the Software and all of its
 component parts.
(2) This EULA will be governed by and construed in accordance with the
 substantive laws of Japan. This EULA will not be governed by the conflict
 of law rules of any jurisdiction or by the United Nations Convention on
 Contracts for the International Sale of Goods, the application of which
 is expressly excluded.
(3) This EULA is the entire agreement between you and PFU LIMITED relating
 to the Software, and it supersedes all prior or contemporaneous oral or
 written communications, proposals and representations with respect to
 the Software.
(4) If any provision of this EULA is held to be invalid or unenforceable
 for any reason, the other provisions shall continue in full force
 and effect.
