CONTRAT DE LICENCE DE L'UTILISATEUR FINAL
POUR RACK2-VIEWER (VERSION D'ESSAI)

Le présent « End-User License Agreement » (« EULA » ou Contrat de licence 
de l'utilisateur final) est une convention licite entre l'acquéreur de 
ce logiciel ou un ayant cause de l'acquéreur et PFU LIMITED (« PFU ») 
pour le logiciel de PFU,à savoir Rack2-Viewer ainsi que le média 
correspondant (nommé « Logiciel » dans les paragraphes qui suivent).

EN INSTALLANT OU EN UTILISANT CE LOGICIEL, VOUS ACCEPTEZ 
TOUS LES TERMES DU PRESENT CONTRAT EULA.  SI VOUS N'ACCEPTEZ 
PAS LES TERMES DU PRÉSENT CONTRAT EULA,N'INSTALLEZ PAS OU 
N'UTILISEZ PAS CE LOGICIEL; VOUS DEVREZ DÉTRUIRE CE 
LOGICIEL.

1. Installation et utilisation
 Vous ne pouvez installer et utiliser le logiciel que sur UN (1) 
 ordinateur à la fois. Vous pouvez utiliser le logiciel pour une 
 période de trente (30) jours après l'installation ; le logiciel 
 arrêtera de marcher après cette période.

2. Limitations
(1) Vous n'êtes pas autorisé à modifier le logiciel ni, sauf dans la 
 limite expressément autorisée par la loi applicable, à effectuer de 
 l'ingénierie inverse, ni décompiler, ni désassembler le logiciel.
(2) Vous n'allez pas copier ou distribuer (y-compris la distribution 
 sur un réseau) les « Rack2 Classeur avec un Viewer incorporé (*.exe) »
 générés par la fonction d'exportation du logiciel, sauf pour votre 
 utilisation uniquement
(3) Vous avez pris connaissance du Logiciel et vous reconnaissez qu'il 
 n'a pas été conçu, ni développé pour être utilisé dans un 
 environnement dangereux (ou Environnement à risque élevé) au risque 
 de provoquer des dommages physiques graves, voire mortelles ou autres 
 pertes fatales. Ces environnements exigent des mesures de sécurité 
 rigoureuses préalables et regroupent, entre autres,les centres de 
 contrôle des centrales nucléaires, les salles de contrôle du 
 trafic aérien, les salles de contrôle des transports publics, les 
 centres médicaux de maintien de la vie et les salles de contrôle de 
 tir de missiles dans des systèmes d'armes.
 Vous acceptez de ne pas utiliser ce Logiciel dans les environnements 
 à risque élevé.
 PFU LIMITED décline toute responsabilité en cas de dommages résultant
 de l'utilisation du logiciel dans de tels environnements à risque.
(4) Vous prenez connaissance et reconnaissez que PFU ne sera pas tenu
 responsable de tout dommage du Logiciel ou de votre ordinateur ou de 
 tout autre ordinateur d'un réseau en cas d'accès non autorisé ou de 
 virus. C'est à vous de prendre les mesures de sécurité qui s'imposent 
 afin de protéger l'accès de votre ordinateur ou des ordinateurs de 
 votre réseau.

3. Titularité des Droits de Propriété Intellectuelle
 Le Logiciel et toute copie autorisée que vous effectuez sont la 
 propriété intellectuelle de PFU et de ses fournisseurs. Le Logiciel 
 est protégé par les lois sur le droit d'auteur, sur la propriété 
 intellectuelle et autres traités.
 Sauf disposition expresse dans les présentes, le présent contrat ne 
 vous concède aucun droit de propriété intellectuelle sur le Logiciel.
 PFU et ses fournisseurs se réservent tous les droits qui ne sont pas 
 expressément concédés.

4. Cession
 Vous acceptez de ne pas transférer ce logiciel à un tiers partie à 
 tout moment pour n'importe quelle raison.

5. Contrôle des exportations
 Vous convenez de respecter l'ensemble des lois applicables 
 internationales et nationales relatives au Logiciel, comprenant les 
 règlements de l'U.S. Export Administration Regulations, ainsi que les 
 restrictions imposées à l'utilisateur final, à l'usage final du 
 produit et aux exportations, restrictions émises par les États-Unis 
 et autres gouvernements.

6. PAS DE GARANTIE
VOUS ACCEPTEZ D'UTILISER CE LOGICIEL «TEL QUEL».  PFU ET SES
FOURNISSEURS MONDIAUX NE FOURNISSENT AUCUNE GARANTIE OU 
RESPONSABILITÉ D'AUCUNE SORTE EN CE QUI CONCERNE LE 
LOGICIEL, ET L'UTILISATION DE CE LOGICIEL EST À VOTRE PROPRE 
RISQUE.  
DANS LES LIMITES AUTORISÉES PAR LA LOIS,PFU ET SES 
DISTRIBUTEURS EXCLUENT TOUTES LES GARANTIES IMPLICITES DE 
COMMERCIABILITÉ, DE COMPATIBILITÉ À UN USAGE PARTICULIER ET 
DE NON-INFRACTION.

7.  LIMITATION DE RESPONSABILITÉ
PFU LIMITED N'EST EN AUCUN CAS ET EN VERTU D'AUCUNE THÉORIE
JURIDIQUE RELATIVE À LA RESPONSABILITÉ DÉLICTUELLE,
CONTRACTUELLE OU AUTRE, RESPONSABLE ENVERS VOUS OU TOUTE 
AUTRE PERSONNE DES DOMMAGES DIRECTS, INDIRECTS, SPÉCIAUX OU 
ACCESSOIRES, DE TOUTE NATURE QUE CE SOIT, RÉSULTANT DE 
L'UTILISATION, DE LA PERFORMANCE OU DE LA NON-CONFORMITÉ DU 
LOGICIEL, NOTAMMENT LES DOMMAGES-INTÉRÊTS POUR PERTE 
D'ACHALANDAGE,ARRÊT DE TRAVAIL OU PERTE DE DONNÉES, LA MORT 
OU LES BLESSURES MÊME SI PFU LIMITED 
A ÉTÉ AVISÉE DE LA POSSIBILITÉ DE TELS DOMMAGES, PAS PLUS 
QUE DES RÉCLAMATIONS PAR UN TIERS QUEL QU'IL SOIT.  DE PLUS, 
CERTAINS RESSORTS N'AUTORISANT PAS L'EXCLUSION OU LA 
LIMITATION DES DOMMAGES ACCESSOIRES OU INDIRECTS, LA 
PRÉSENTE LIMITATION PEUT NE PAS VOUS CONCERNER.

8. Règlements divers
(1) En cas de non-respect des termes et conditions du présent contrat  
 «EULA», cette licence ainsi que vos droits sur ce Logiciel seront 
 immédiatement annulés.
 Le cas échéant, vous devrez détruire toutes les copies en votre 
 possession du Logiciel et de ses composants.
(2) Le présent contrat est régi et interprété selon les lois en 
 vigueur au  Japon. Le présent contrat n'est pas régi par les règles 
 de conflits de lois de ces  pays, ni par la Convention des Nations 
 Unies sur les contrats de vente  internationale  de marchandises, 
 dont l'application est expressément exclue.
(3) Le présent contrat constitue l'intégralité d'un accord entre vous  
 et PFU LIMITED concernant le Logiciel. Il se substitue à toutes 
 déclarations orales ou expresses, ainsi qu'aux engagements ou 
 publicités antérieures relatifs au Logiciel.
(4) Si une quelconque stipulation du présent contrat s'avère nulle et 
 inopposable, la validité et l'opposabilité des autres stipulations 
 n'en seront pas affectées.

END-USER LICENSE AGREEMENT
FOR RACK2-VIEWER (TRIAL VERSION)

This End-User License Agreement ("EULA") is a legal agreement between
the original end user of this software and PFU LIMITED ("PFU") for the
trial version of the PFU software known as the Rack2-Viewer, including
the associated media ("Software").

BY INSTALLING OR USING THIS SOFTWARE, YOU AGREE TO BE BOUND
BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS
OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE; YOU SHALL
DESTROY THE SOFTWARE.

1. Installation and Use
 You may install and use the Software on any one (1) computer at a time.
 You may use the Software for up to thirty (30) days after installation,
 after which time the Software will not function.

2. Restrictions
(1) You shall not modify or, except to the extent expressly permitted
 by applicable law, reverse engineer, including, without limitation,
 decompile or disassemble, the Software.
(2) You shall not copy or distribute (including network distribution)
 "Rack2 Binder with embedded Viewer (*.exe)" generated by the export
 function of the Software, except for your own personal use.
(3) You acknowledge and agree that the Software is not designed,
 developed or manufactured for any use that may give rise to fatal
 risks or dangers such that, unless extremely high safety is secured,
 the use could lead to death, personal injury, severe physical damage,
 or other loss (hereinafter, "High Safety Required Use"), including
 without limitation, nuclear reaction control in nuclear facilities,
 aircraft flight control, air traffic control, mass transport control,
 medical life support systems, and missile launch control in weapon
 systems.
 You agree not to use the Software in any High Safety Required Use.
 PFU LIMITED disclaims any liability for damages cause by use of the
 Software in any High Safety Required Use.
(4) You acknowledge and agree that PFU is not liable for any damage to the
 Software or to your computer or computer network caused by unauthorized
 access or computer viruses. It is your responsibility to take proper
 security measures to avoid unauthorized access to your computer or
 computer network.

3. Reservation of Rights and Ownership
 PFU or its suppliers own the title, copyright, and other intellectual
 property rights in the Software. The Software is protected by copyright
 and other intellectual property laws and treaties. Except as expressly
 stated herein, this EULA does not grant you any intellectual property
 rights in the Software.
 All rights not expressly granted are reserved by PFU and its suppliers.

4. Assignment
 You agree not to transfer the Software to any third party at any time
 for any reason.

5. Export Control
 You agree to comply with all applicable international and national
 laws that apply to the Software, including the U.S. Export Administration
 Regulations, as well as end-user, end-use, and destination restrictions
 issued by the U.S. and other governments.

6. NO WARRANTY
 YOU AGREE TO ACCEPT THIS SOFTWARE "AS IS." PFU AND ITS
 SUPPLIERS PROVIDE NO WARRANTY OR GUARANTY WHATSOEVER
 REGARDING THE SOFTWARE, AND ANY USE OF THE SOFTWARE IS AT
 YOUR OWN RISK. TO THE MAXIMUM EXTENT ALLOWABLE BY LAW, PFU
 AND ITS AFFILIATES EXCLUDE ALL IMPLIED WARRANTIES OF
 MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
 NON-INFRINGEMENT.

7. LIMITATION OF LIABILITY
 UNDER NO CIRCUMSTANCES SHALL PFU OR ITS SUPPLIERS BE LIABLE
 TO YOU OR TO ANY OTHER PERSON UNDER TORT, CONTRACT, OR ANY
 OTHER LEGAL THEORY, FOR ANY DIRECT, INDIRECT, SPECIAL,
 INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER
 ARISING FROM THE USE, PERFORMANCE OR NON-PERFORMANCE OF THE
 SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS
 OF PROFITS, LOSS OF GOODWILL, LOSS OF DATA, DEATH, OR
 PERSONAL INJURY, EVEN IF PFU HAS BEEN INFORMED OF THE
 POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT
 ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR
 CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS AND EXCLUSIONS
 MAY NOT APPLY TO YOU.

8.Miscellaneous Provisions
(1) If you fail to comply with the terms and conditions of this EULA,
 this license and your rights in the Software shall terminate immediately.
 In such event, you must destroy all copies of the Software and all of its
 component parts.
(2) This EULA will be governed by and construed in accordance with the
 substantive laws of Japan. This EULA will not be governed by the conflict
 of law rules of any jurisdiction or by the United Nations Convention on
 Contracts for the International Sale of Goods, the application of which
 is expressly excluded.
(3) This EULA is the entire agreement between you and PFU LIMITED relating
 to the Software, and it supersedes all prior or contemporaneous oral or
 written communications, proposals and representations with respect to
 the Software.
(4) If any provision of this EULA is held to be invalid or unenforceable
 for any reason, the other provisions shall continue in full force
 and effect.
