RACK2-FILER 최종 사용자 사용권 계약서(시험판) 이 최종 사용자 사용권 계약서("EULA")는 이 소프트웨어의 원래의 최종 사 용자와 PFU LIMITED ("PFU") 사이에 관련 매체를 포함한 Rack2-Filer라고 하는 PFU 소프트웨어의 시험판("소프트웨어")에 대해 체결된 법률적 계약서 입니다. 이 소프트웨어를 설치, 복사 또는 사용함으로써 귀하는 본 EULA의 조건에 구속되는 것에 동의하는 것입니다. 본 EULA의 조건에 동의하지 않을 경우 소프트웨어를 설치, 복사 또는 사용하지 마십시오. 해당될 경우 소프트웨어 를 구매점에 반품하여 전액 환불 받을 수 있습니다. 1. 설치와 사용 이 소프트웨어를 복수의 컴퓨터에 설치할 수 있습니다. 그러나 제3자에게 재배포할 수 없습니다. 2. 제한 (1) 소프트웨어를 개조할 수 없으며, 또한 현행 법률에 의해 명시적으로 승인된 경우를 제 외하고 소프트웨어를 역엔지니어링, 역컴파일링 또는 분해할 수 없습니다. (2) 소프트웨어의 내보내기 기능에 의해서 작성된 "Viewer (*.exe)가 포함 된 Rack2 바인더"를 개인적인 용도를 제외하고는 복사 또는 배포(네트워 크 배포 포함)할 수 없습니다. (3) 귀하는 소프트웨어가 핵 시설의 핵 반응, 항공기 비행 관제, 항공 관제, 대중 교통 제어, 의료 생명 지원 장치, 무기 시스템의 미사일 발사 제어 등과 같이 극히 높은 안전이 확보되지 않을 경우 사망, 부상, 심각 한 물리적 피해, 또는 부문의 기타 손실로 이어질 수 있는 치명적 위험을 유발할 수 있는 용도(이하 "고도 안전이 요구되는 사용 부문")로 사용되도 록 고안, 개발 또는 제조되지 않음을 인정하고 동의합니다. 귀하는 고도 안전이 요구되는 사용 부문에서 소프트웨어를 사용하는 것에 동의하지 않습니다. PFU LIMITED는 소프트웨어를 고도 안전이 요구되는 사용 부문에서 사용하 여 발생하는 피해에 대해 어떤 책임도 지지 않습니다. (4) 귀하는 PFU가 무단 액세스 또는 컴퓨터 바이러스로 인한 소프트웨어 및 컴퓨터 또는 컴퓨터 네트워크의 어떤 피해에 대해서도 책임지지 않는다는 것을 인정하고 동의합니다. 귀하는 컴퓨터 또는 컴퓨터 네트워크에 대한 무단 액세스를 피하기 위한 적절한 보안 조 치를 취할 책임이 있습니다. 3. 권리와 소유권의 보유 PFU 또는 그 공급자는 소프트웨어에 대한 권리, 저작권, 기타 지적재산권 을 소유합니다. 소프트웨어는 저작권 및 기타 지적 재산에 관한 법률과 조약에 의해 보호됩니다. 본 계 약서에서 명시적으로 언급된 경우를 제외 하고, 본 EULA는 귀하에게 소프트웨어에 대한 어떤 지적 재산권도 부여하 지 않습니다.명시적으로 부여되지 않은 모든 권리는 PFU와 그 공급자들에 의해 소유됩니다. 4. 양도 귀하는 소프트웨어를 어떤 제3자에게 양도하는 것에 대해 언제나 어떤 이 유로든 동의하지 않습니다. 5. 수출 통제 귀하는 미국 수출 관리 규정(U.S. Export Administration Regulations)을 포함하여 소프 트웨어에 적용되는 모든 현행 국제법 및 국내법과, 미국 정 부 및 기타 정부에 의해 발표된 최종 사용자, 최종 사용 및 목적지 제한을 준수하는 것에 동의합니다. 6. 무보증 귀하는 이 소프트웨어를 "그대로" 수용하는 것에 동의합니다. PFU와 그 공 급자는 소프트웨어와 관련하여 어떤 종류의 보증 또는 보장도 제공하지 않 으며, 소프트웨어의 어떤 사용도 귀하의 책임입니다. 법이 허용하는 최대 한도 내에서 PFU와 그 계열사는 상품성, 특정 목적에 대한 적합성, 권리 불 침해에 대한 모든 묵시적 보증을 배제합니다. 7. 책임 제한 PFU 또는 그 공급자는 소프트웨어의 사용, 동작 또는 비동작으로 인해서 이익 상실, 영업권 상실, 데이터 손실, 사망 또는 부상을 포함하여 직접적, 간접적, 특수한, 우발적 또는 결과 적인 어떤 성격의 피해에 대해서도, 피해가 발생할 가능성에 대해 사전에 통보받은 경우에조차, 불법 행위, 계약 또는 기타 어떤 법률 이론에 기초해 서도 귀하 또는 어떤 제3자에게도 결코 책임지지 않습니다. 일부 관할지는 우발적 또는 결과적 피해의 배제 또는 제한을 허용하기 때문에 이러한 제한 및 배제 조항들은 귀하에게 적용되지 않을 수도 있습니다. 8. 기타 조항 (1) 본 EULA의 조건을 준수하지 않을 경우 본 사용권과 소프트웨어에 대한 귀하의 권리는 즉시 종료됩니다.그러한 경우에 귀하는 소프트웨어의 모든 사본과 그 구성요소 부분 전체를 폐기해야 합니다. (2) 본 EULA는 일본의 실정법에 준거하여 해석됩니다. 본 EULA는 해당 관할 지의 법률 충돌 규정 또는 국제 상품 판매 계약에 대한 UN 협정에 준거하 며, 후자의 적용은 명시적으로 배제됩니다. (3) 본 EULA는 소프트웨어에 관한 귀하와 PFU LIMITED 사이의 전체 계약이 며, 소프트웨어에 관한 모든 이전의 또는 현재의 구두 또는 문서 합의, 제안, 약정에 우선합니다. (4) 본 EULA의 어떤 조항이 어떤 사유로 인해서든 무효가 되거나 실행 불가 능해질 경우에도 나머지 조항은 계속 효력을 유지합니다. PFU LIMITED END-USER LICENSE AGREEMENT FOR RACK2-FILER (TRIAL VERSION) This End-User License Agreement ("EULA") is a legal agreement between the original end user of this software and PFU LIMITED ("PFU") for the trial version of the PFU software known as the Rack2-Filer, including the associated media("Software"). BY INSTALLING OR USING THIS SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE; YOU SHALL DESTROY THE SOFTWARE. 1. Installation and Use You may install this software on multiple computers. However, it cannot be redistributed to a third party. 2. Restrictions (1) You shall not modify or, except to the extent expressly permitted by applicable law, reverse engineer, including, without limitation, decompile or disassemble, the Software. (2) You shall not copy or distribute (including network distribution) "Rack2 Binder with embedded Viewer (*.exe)" generated by the export function of the Software, except for your own personal use. (3) You acknowledge and agree that the Software is not designed, developed or manufactured for any use that may give rise to fatal risks or dangers such that, unless extremely high safety is secured, the use could lead to death, personal injury, severe physical damage, or other loss (hereinafter, "High Safety Required Use"), including without limitation, nuclear reaction control in nuclear facilities, aircraft flight control, air traffic control, mass transport control, medical life support systems, and missile launch control in weapon systems. You agree not to use the Software in any High Safety Required Use. PFU LIMITED disclaims any liability for damages cause by use of the Software in any High Safety Required Use. (4) You acknowledge and agree that PFU is not liable for any damage to the Software or to your computer or computer network caused by unauthorized access or computer viruses. It is your responsibility to take proper security measures to avoid unauthorized access to your computer or computer network. 3. Reservation of Rights and Ownership PFU or its suppliers own the title, copyright, and other intellectual property rights in the Software. The Software is protected by copyright and other intellectual property laws and treaties. Except as expressly stated herein, this EULA does not grant you any intellectual property rights in the Software. All rights not expressly granted are reserved by PFU and its suppliers. 4. Assignment You agree not to transfer the Software to any third party at any time for any reason. 5. Export Control You agree to comply with all applicable international and national laws that apply to the Software, including the U.S. Export Administration Regulations, as well as end-user, end-use, and destination restrictions issued by the U.S. and other governments. 6. NO WARRANTY YOU AGREE TO ACCEPT THIS SOFTWARE "AS IS." PFU AND ITS SUPPLIERS PROVIDE NO WARRANTY OR GUARANTY WHATSOEVER REGARDING THE SOFTWARE, AND ANY USE OF THE SOFTWARE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT ALLOWABLE BY LAW, PFU AND ITS AFFILIATES EXCLUDE ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 7. LIMITATION OF LIABILITY UNDER NO CIRCUMSTANCES SHALL PFU OR ITS SUPPLIERS BE LIABLE TO YOU OR TO ANY OTHER PERSON UNDER TORT, CONTRACT, OR ANY OTHER LEGAL THEORY, FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER ARISING FROM THE USE, PERFORMANCE OR NON-PERFORMANCE OF THE SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF DATA, DEATH, OR PERSONAL INJURY, EVEN IF PFU HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. 8.Miscellaneous Provisions (1) If you fail to comply with the terms and conditions of this EULA, this license and your rights in the Software shall terminate immediately. In such event, you must destroy all copies of the Software and all of its component parts. (2) This EULA will be governed by and construed in accordance with the substantive laws of Japan. This EULA will not be governed by the conflict of law rules of any jurisdiction or by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. (3) This EULA is the entire agreement between you and PFU LIMITED relating to the Software, and it supersedes all prior or contemporaneous oral or written communications, proposals and representations with respect to the Software. (4) If any provision of this EULA is held to be invalid or unenforceable for any reason, the other provisions shall continue in full force and effect. PFU LIMITED
