CONTRATO DE LICENCIA DE USUARIO FINAL DE 
RACK2-FILER (VERSIÓN DE PRUEBA)

Este contrato de licencia de usuario final ("CLUF") es un acuerdo 
legal entre el comprador original de este software o su delegado y PFU 
LIMITED ("PFU") acerca de la versión de prueba del software de PFU 
conocido como Rack2-Filer, incluyendo los medios asociados 
("Software").

LA INSTALACIÓN O USO DE ESTE SOFTWARE IMPLICA LA ACEPTACIÓN 
DE LOS TÉRMINOS DE ESTE CLUF.  SI NO ESTÁ DE ACUERDO CON LOS 
TÉRMINOS DE ESTE CLUF, NO INSTALE NI UTILICE EL SOFTWARE; 
DEBERÁ DESTRUIRLO.

1. Instalación y uso
 Puede instalar este programa en varios equipos. No obstante, no 
 podrá redistribuirlo a terceros.

2. Restricciones
(1) No debe modificar ni, a excepción de lo dispuesto explícitamente 
 por la legislación  aplicable, aplicar ingeniería inversa, incluyendo 
 sin limitación la descompilación o desmontaje del Software.
(2) No debe copiar o distribuir (incluyendo la distribución en red) 
 "Rack2 archivador con Viewer de incrustado(*.exe)" generados por 
 medio de la función de exportación del Software, a no ser que lo 
 destine a su uso personal.
(3) Usted acepta y admite que el Software no ha sido diseñado, 
 desarrollado o fabricado para ningún uso que pueda conducir a riesgos 
 fatales o peligros tales que, a menos que se tomen grandes medidas de 
 seguridad, puedan derivar en muerte, lesión personal, lesiones 
 físicas severas u otras pérdidas (en lo sucesivo "Uso con requisitos 
 de alta seguridad"), incluyendo sin limitación, control de reacciones 
 nucleares en instalaciones nucleares, control de vuelo de aviones, 
 control de tráfico aéreo, control de transporte masivo, sistemas
 médicos de mantenimiento de la vida y control de lanzamiento de 
 misiles en sistemas armamentísticos. 
 Usted acepta no utilizar el Software en entornos de Uso con requisitos 
 de alta seguridad. 
 PFU LIMITED descarga cualquier responsabilidad por daños causados por el 
 uso del Software en Usos con requisitos de alta seguridad.
(4) Usted admite y acuerda que PFU no es responsable de ningún daño 
 provocado sobre el Software o en su equipo o red informática causado 
 por un acceso no autorizado o un virus informático.  Es su 
 responsabilidad tomar las medidas de seguridad adecuadas para evitar 
 el acceso no autorizado a su equipo o red informática.

3. Derechos y propiedad reservada
 PFU o sus proveedores son los propietarios del título, derechos de 
 copia y demás derechos de propiedad intelectual del Software. El 
 Software está protegido por las leyes de derechos de copia y otras 
 leyes de propiedad intelectual.  Excepto por lo declarado 
 explícitamente aquí, este CLUF no le garantiza ningún derecho de 
 propiedad intelectual sobre el Software. 
 PFU y sus proveedores se reservan todos los derechos no otorgados 
 explícitamente.

4. Asignación
 Usted acepta no transferir el Software a ninguna otra parte en ningún 
 momento y por ninguna razón.

5. Control de exportación
 Usted acepta cumplir con toda la legislación internacional y nacional 
 aplicable al Software, incluyendo las normas de la administración de 
 exportación de EE.UU., así como las restricciones de destino emitidas 
 por los EE. UU. y otros gobiernos.

6. EXENCIÓN DE GARANTÍA
 USTED ADMITE ACEPTAR ESTE SOFTWARE "TAL CUAL".  PFU Y SUS
 PROVEEDORES NO OFRECEN GARANTÍAS DE NINGÚN TIPO EN
 RELACIÓN CON EL SOFTWARE, Y CUALQUIER USO DEL SOFTWARE
 SE REALIZARÁ A SU PROPIO RIESGO.  HASTA LOS LÍMITES
 PERMITIDOS POR LA LEGISLACIÓN VIGENTE, PFU Y SUS
 AFILIADOS EXCLUYEN TODAS LAS GARANTÍAS IMPLÍCITAS DE
 COMERCIABILIDAD, AJUSTE A UNA FINALIDAD PARTICULAR
 Y NO INFRACCIÓN.

7.  LIMITACIÓN DE RESPONSABILIDAD
 NI PFU NI NINGUNO DE SUS PROVEEDORES SERÁ, BAJO NINGUNA 
 CIRCUNSTANCIA, RESPONSABLE ANTE USTED O CUALQUIER OTRA 
 PERSONA POR DELITO, CONTRATO O CUALQUIER OTRA TEORÍA LEGAL, 
 POR CUALQUIER DAÑO DIRECTO, INDIRECTO, ESPECIAL, ACCIDENTAL 
 O CONSECUENTE DE NINGÚN TIPO, DERIVADO DEL USO, EXPLOTACIÓN 
 O IMPOSIBILIDAD DE EXPLOTACIÓN DEL SOFTWARE, INCLUYENDO, 
 SIN LIMITACIÓN, PERJUICIOS POR PÉRDIDA DE BENEFICIOS, 
 PÉRDIDA DE BUENAS RELACIONES O PÉRDIDA DE DATOS, INCLUSO 
 AUNQUE PFU HAYA SIDO INFORMADO DE LA POSIBILIDAD DE TALES 
 PERJUICIOS. ALGUNAS JURISDICCIONES NO PERMITEN LA EXCLUSIÓN 
 O LIMITACIÓN DE DAÑOS ACCIDENTALES O CONSECUENTES, POR LO 
 QUE DICHAS LIMITACIONES Y EXCLUSIONES PODRÍAN NO SERLE DE 
 APLICACIÓN.

8. Cláusulas misceláneas
(1) Si no cumple los términos y condiciones de este CLUF, esta 
 licencia y sus derechos sobre el Software se darán inmediatamente por 
 concluidos. En tal caso, deberá destruir todas las copias del 
 Software, así como todos sus componentes.
(2) Este CLUF quedará gobernado y puesto en vigor por la legislación 
 de Japón. Este CLUF no quedará gobernado por el conflicto de normas 
 legales de cualquier jurisdicción o por la Convención de Naciones 
 Unidas sobre Contratos de venta internacional de bienes, cuya 
 aplicación queda explícitamente excluida.
(3) Este CLUF representa el acuerdo completo entre usted y PFU LIMITED 
 en relación con el Software y sustituye a cualquier acuerdo anterior 
 o contemporáneo, oral o escrito, propuesta o representación en 
 relación con el Software.
(4) Si alguna de las cláusulas de este CLUF se considera invalidada o 
 es imposible ponerla en vigor por alguna razón, las demás cláusulas 
 continuarán siendo vigentes y efectivas.

END-USER LICENSE AGREEMENT
FOR RACK2-FILER (TRIAL VERSION)

This End-User License Agreement ("EULA") is a legal agreement between
the original end user of this software and PFU LIMITED ("PFU") for the
trial version of the PFU software known as the Rack2-Filer, including
the associated media("Software").

BY INSTALLING OR USING THIS SOFTWARE, YOU AGREE TO BE BOUND
BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS
OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE; YOU SHALL
DESTROY THE SOFTWARE.

1. Installation and Use
You may install this software on multiple computers. However, it
cannot be redistributed to a third party.


2. Restrictions
(1) You shall not modify or, except to the extent expressly permitted
 by applicable law, reverse engineer, including, without limitation,
 decompile or disassemble, the Software.
(2) You shall not copy or distribute (including network distribution)
 "Rack2 Binder with embedded Viewer (*.exe)" generated by the export
 function of the Software, except for your own personal use.
(3) You acknowledge and agree that the Software is not designed,
 developed or manufactured for any use that may give rise to fatal
 risks or dangers such that, unless extremely high safety is secured,
 the use could lead to death, personal injury, severe physical damage,
 or other loss (hereinafter, "High Safety Required Use"), including
 without limitation, nuclear reaction control in nuclear facilities,
 aircraft flight control, air traffic control, mass transport control,
 medical life support systems, and missile launch control in weapon
 systems.
 You agree not to use the Software in any High Safety Required Use.
 PFU LIMITED disclaims any liability for damages cause by use of the
 Software in any High Safety Required Use.
(4) You acknowledge and agree that PFU is not liable for any damage to the
 Software or to your computer or computer network caused by unauthorized
 access or computer viruses.  It is your responsibility to take proper
 security measures to avoid unauthorized access to your computer or
 computer network.

3. Reservation of Rights and Ownership
 PFU or its suppliers own the title, copyright, and other intellectual
 property rights in the Software.  The Software is protected by copyright
 and other intellectual property laws and treaties.  Except as expressly
 stated herein, this EULA does not grant you any intellectual property
 rights in the Software.
 All rights not expressly granted are reserved by PFU and its suppliers.

4. Assignment
 You agree not to transfer the Software to any third party at any time
 for any reason.

5. Export Control
 You agree to comply with all applicable international and national laws
 that apply to the Software, including the U.S. Export Administration
 Regulations, as well as end-user, end-use, and destination restrictions
 issued by the U.S. and other governments.

6. NO WARRANTY
 YOU AGREE TO ACCEPT THIS SOFTWARE "AS IS." PFU AND ITS
 SUPPLIERS PROVIDE NO WARRANTY OR GUARANTY WHATSOEVER
 REGARDING THE SOFTWARE, AND ANY USE OF THE SOFTWARE
 IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT ALLOWABLE
 BY LAW, PFU AND ITS AFFILIATES EXCLUDE ALL IMPLIED
 WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
 PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. LIMITATION OF LIABILITY
 UNDER NO CIRCUMSTANCES SHALL PFU OR ITS SUPPLIERS BE LIABLE
 TO YOU OR TO ANY OTHER PERSON UNDER TORT, CONTRACT, OR ANY
 OTHER LEGAL THEORY, FOR ANY DIRECT, INDIRECT, SPECIAL,
 INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER
 ARISING FROM THE USE, PERFORMANCE OR NON-PERFORMANCE OF THE
 SOFTWARE, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS
 OF PROFITS, LOSS OF GOODWILL, LOSS OF DATA, DEATH, OR
 PERSONAL INJURY, EVEN IF PFU HAS BEEN INFORMED OF THE
 POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW
 THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL
 DAMAGES, SO THESE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY
 TO YOU.

8.Miscellaneous Provisions
(1) If you fail to comply with the terms and conditions of this EULA,
 this license and your rights in the Software shall terminate immediately.
 In such event, you must destroy all copies of the Software and all of its
 component parts.
(2) This EULA will be governed by and construed in accordance with the
 substantive laws of Japan. This EULA will not be governed by the conflict
 of law rules of any jurisdiction or by the United Nations Convention on
 Contracts for the International Sale of Goods, the application of which
 is expressly excluded.
(3) This EULA is the entire agreement between you and PFU LIMITED relating
 to the Software, and it supersedes all prior or contemporaneous oral or
 written communications, proposals and representations with respect to
 the Software.
(4) If any provision of this EULA is held to be invalid or unenforceable
 for any reason, the other provisions shall continue in full force
 and effect.
